A court martial was never a pleasant process and should never become a pleasant process. It was a necessary evil. Something that had to be done, to serve as enough of a threat to discourage so-called 'court martial offenses'. One would like to think that, within an organisation as proud as Starfleet, such things would be rare, but they were depressingly frequent.

Rachel Deacon sat to the right of the president's chair in the designated court room on the station, scrolling through her PADD to familiarise herself with the two cases being presented. The first was the captain of the Phoenix, who was charged with assault of a fellow officer as well as pre-emptive strike against a Klingon vessel. The second concerned her far more: the Phoenix's chief of flight operations, charged with insubordination, sabotage, espionage and the kidnap and detention of a Starfleet officer. Quite the rap sheet. Granted, Deacon, Stark and Archangel had all petitioned the Star Empire for the Lieutenant's extradition and the return of the captured officer, but it was time for Jiseth to face the consequences of what they had done. Shuffling through the PADDs, she found one that contained a statement from the captured officer, who was still undergoing treatment in sickbay.

With a heavy sigh, Rachel sat back in her chair and watched as various members of the Phoenix crew started to take up places in the stands to watch the proceedings. She would much rather had had a closed meeting, but justice had to be seen to be served. All she could hope for was that everything went smoothly. Looking up, she nodded to Corman Stark as he took the centre seat of the prosecution.

They made this floor un-carpeted on purpose, Stark thought, as his footfalls echoed rather ominously. He entered the main conference hall, acutely aware of how stark (no pun intended) the furnishings were. This was not a reception area for the Grand Poobah of Planet Whatever. This was a smaller chamber...built almost as if the SCE had planned on them holding court here. Then again, they were the major Federation installation in local space. As such, Athena was the center of justice for the Fifth Fleet.

Nodding to Deacon, Stark moved to his desk. He'd been named as the Chair of Prosecution for this particular court martial. Wonder why they didn't give me the Defense? He supposed it was his warm and fluffy demeanor. "Admiral," Stark said, taking a quick glance at the padd screen. He'd spent most of the last three days reading over the facts of the case, so there wasn't much to refresh. "I guess this will be the must-see event of the quadrant. I practically had to threaten the Federation News Service with a walk out the airlock before they stopped asking me questions." Thankfully, the actual proceedings were sealed. "Here we are. You know, when I was a kid, my mom told me that she hoped one day I would get a child as big a pain in the ass as I was. I never expected it would be named the USS Phoenix."

It had been a long quiet walk from sickbay. Even longer than it was from her quarters she was confined to the biobed. The four guards in amber that surrounded her marched in step with all eyes front. They reminded her of drill team cadets showing off during a parade, something which this walking seemed exactly to be. They lived in an age where matter could be moved from place to place instantly and here they were taking up precious time.

The onlookers the passed were the crux of the issue. Brought through the corridors like the heretic among the believers. She was the witch to be burned or hanged. Or both. This would not be the drumhead trial of Simon Tarses, no. She knew this very well. She was the fears of that trial made manifest. Only this time the prosecution would be the even-headed and even-handed Corman Stark.

Though she was not bound by cuffs, her arms were crossed behind her back. Jiseth restraining herself to bring focus to the current situation. Still a reprieve from the Romulan fleet where she would have been shot ages ago for a much lighter offense. At the current moment, she took to mentally simulating how many of the guards she could take out if she grabbed for one of their phasers. It always ended in the same conclusion that was in no doubt akin to the the coming trial: her odds sucked.

As she and her escort entered, Jiseth caught the tail bits of the exchange between the admirals. Stark could make jokes while sober? She filed that bit of information away, but maintained her gaze downward and slightly in front of her two guards ahead of her. Like a perfectly synchronized formation, the forward pair flew off to guard the entrance while the aft pair stood on opposite sides of the Romulan's chair behind her.

Just a few short, incredibly painful hours and it'll be over. I'll have plenty of time to paint those model warbirds that'll hang above Callion's crib when this is all said and done. Silver lining...

Archangel took one last look in the mirror to make sure that she was presentable, straightening the tunic of her dress uniform yet again. Court martials were never something to be taken lightly in the least. She sighed heavily. Yes, it was thought that at least one of the two charges was going to be waived, but she was still very concerned about them.

She wasn't sure where Gabriel was and, in any case, she didn't want to cause him any more stress, so she quietly slipped out of her quarters. Immediately, the two security officers who had been posted outside fell into step on either side of her to guide her to the court martial.

As they arrived at the conference hall that had been designated for the event, the young Romulan nodded to the security officers waiting outside, then stepped inside and took a seat toward the back of the floor. They may have combined the two trials to save time, but Jiseth had been scheduled to go first. She nodded briefly to the other Romulan before dropping her gaze to her hands, folded in her lap.

Since a court martial required three command or flag level officers and his ship was the only other one currently docked at the station, so he had been invited to be the third part of their triple threat. Looking out over the floor where the officers facing the court martial had arrived, she let out a sigh and looked to Stark.

"It would seem that everyone is present. Shall we get started?"

"Maybe the Cardassians are on to something, after all, with their pathetic legal system," Stark muttered, glancing up as T'Koris and Jiseth entered the chambers.  Once the accused had arrived, his demeanor changed from sardonic to completely business-like.  No matter how big a pain this was, it was to be done properly.  Corman Stark was not a by-the-numbers officer.  Never had been, not as a captain, and not now as a flag officer.  However, one thing he did have ultimate respect for was the chain of command.  It was what kept people alive in the most unforgiving of work environments.  

And Lieutenant Jiseth had danced all over that chain, just as if she was listening to music played on a harp from hell.

Moving out form behind his table, Stark nodded to Captain Salek as the Vulcan filed in.  He knew of the long-standing problems T'Koris had with the captain, and wondered which god of fate had intervened to put the man on this committee.  Or, perhaps, someone in the JAG office had known about it, too.

"Gentlebeings," he said, his voice carried over his commbadge, "we meet here under the gravest of circumstances - to determine the level of wrongdoing in the actions of two officers.  This court-martial is to be carried out under the Uniform Code of Starfleet Justice, as established by the integration of Starfleet into the Charter of the United Federation of Planets in 2161.  This court will stand witness to the charges as read, to the responses and examination of the accused.  This court reminds all present that the accused stand innocent until guilt is proven."

He turned back toward the sitting table.  "For the record, the committee of command-level officers includes Rear Admiral Rachel Deacon, CO of Starbase Athena.  Rear Admiral Lower Half Corman Stark, Executive Officer of Starbase Athena.  Captain Salek, commanding officer of USS April."

Rachel sat forward in her chair, pressing her index fingers together and lacing her other fingers together as she listened to Stark presenting the proceedings.  It was by the book, just as he was known for doing and she appreciated that.  Romulans could be slippery and devious.  Whether they where officers under her or not, she didn't want to give either of them the possibility of overturning the ruling on some fluke.

She inclined her head as he mentioned her name, as did Salek, and she then got to her feet, picking up a PADD with the case files saved onto it.

"The first case brought before us today concerns Lieutenant Jiseth, Chief of Flight Operations aboard the Federation vessel USS Phoenix, registration NCC - 65025.  Following the events of Stardate 55536.8, you have been charged with: Insubordination against your captain; sabotage of a vessel loaned to your crew by the Romulan Star Empire for the purposes of conducting a series of war games in the interest of furthering diplomatic relations., kidnap of the Federation officer Lieutenant Junior Grade Zero Alpha with a view to turning her over to the Romulan Intelligence services and espionage on behalf of the Romulan Star Empire.  Present your defense."

Their names are Lieutenant Commander Julia Rellek, Lieutenant Raynor Hughes, Ensign Nelkar Epath, and Ensign T'Mir. The Defense motions to waive the charge of sabotage as it puts the defendant in double jeopardy with the charge of insubordination due to gross negligence on part of the officer in command. Lastly, the Defense motions to prohibit all character witness testimony and physical evidence regarding the interactions and relationship between the defendant and Captain Archangel T'Koris as neither party can confirm nor deny any association without the Chief of Starfleet Intelligence present."

Stark knew that the proceedings would likely be tense, but there seemed to be an extra level of frostiness in Deacon's voice. Perhaps something about it all had amped up that Vulcan-like stoicism and brought it to the forefront. Seeing an experiment like the USS Phoenix unravel before you would do that to a person, he imagined.

He turned his eyes from Deacon to Jiseth as the Romulan, serving as her own counsel, replied to the charges. Stark was mostly expressionless, boring right into her with his flint grey gaze as the woman spoke. He genuinely hoped that Jiseth wasn't just bullshitting and trying to put off the inevitable. Although his trust in her judgment had taken a serious hit, he still thought better of her than that.

"This Chair has no objection to the aforenamed witnesses," Stark said, his voice quiet but carrying through the commbadge. "The request to waive charges of sabotage and the claim of double jeopardy have no bearing on this hearing. They are separate charges, and the negligence of Captain T'Koris will be determined by this court. Until that point, any and all such charges are in the realm of speculation, and beyond the purview of the Defendant."

Stark continued, his voice and eyes as focused as an SCE laser drill. "Finally, the motion to dismiss witness and testimony on interactions between the Defendant and her Commanding Officer...the Prosecution finds said request to again be beyond the purview and scope of this trial. This Chair moves that any and all such interaction, as it relates to this hearing, be admissible."

Part of her wondered if Deacon's visor could see how much her body heat fluctuated. Seeing the Romulan's stress levels as indication of lying or if she were mentally fit to even defend herself. A Betazoid would actually have been preferable.

A slight glance to the Captain before returning her gaze to Deacon. Jiseth had no real intention of doing this as a favor for T'Koris. The fact remained that she had more to loose than her superior and had already been shown a demonstration of how paperwork could magically disappear and logs rewritten. It made her all the more uneasy, vulnerable even, with the eyes of three admirals on her.

Take a gift in the hand Stark, don't draw this out longer than it has to...

Corman was silent for a long moment, tapping his index finger against his lower lip, giving Jiseth a long and unhappy look. He wasn't sure what game she was playing, but he knew that she had the ability to play them all, if he let her. If he wasn't careful, this whole thing could be turned into an argument for something else, and nobody would remember what in the hell they'd started talking about.

"You claim that calling your relationship with Captain T'Koris to the stand can or should not be done without official representation from Starfleet Intelligence? Lieutenant Jiseth, may this Chair remind you that your actions were witnessed by a bridge full of your uniformed peers? May this Chair remind you that your actions were recorded by the on-deck monitors? May this Chair beg to know what your actions aboard the IRW Gannius, the actual things that are on trial, have to do with what relationship, personal or professional, you have with Captain T'Koris?"

Jiseth maintained her even gaze to Deacon, still half wondering what the Vulcan admiral saw in kind. Bringing up Section 31 into these proceedings was a surefire way to be sent to the stockade or worse. Mind probes were succinctly more pleasant than a counselor's office with a certain raving crewman. Group therapy was it called? The Romulan saw it as an efficient means of group torture.

This would be a perfect case study situation. The perils of the legal system when looking for answers it cannot prove or even know without rampant speculation and outright paranoia. This was the moment she always feared and she hated T'Koris for it. There was another possibility: Stark was in on it. That would make him more slippery than Mabus. Than even a Romulan. The moment she reveal anything she knew, they would simply slap more charges on her for coming forth with state secrets. She cut that line of thinking short. It was a road she could not go down.

A quiet moment while she kept focused on the woman behind the visor. She still had to tell the truth.

Throughout the exchange between Jiseth and Stark, Rachel had been taking notes on a PADD so that she could refer back to exact snippets and phrases should she need to. The majority of her attention, however, was focused on the Romulan sat out on the floor. Due to her familiarity with Vulcans, getting a reading on Jiseth's physiological state wasn't too difficult once she had the subtle differences pegged. It was obvious that she was under significant stress, but Rachel would have been concerned if she hadn't read that in the Romulan. A court martial was an extremely stressful event. Personnel who were truly calm and not just acting calm were to be watched closely as it was as large a red flag as anyone was likely show.

Pushing herself to her feet, she cleared her throat to attract the attention to herself before she spoke. "Captain T'Koris' occasional affiliation with Starfleet Intelligence is marked on her personnel file and as such is available to anyone in the service, even if the specifics of classified missions are not. As your relationship with your commanding officer will be an important element in the elaboration of the insuborination charge, your request to omit the details of your associations with your commanding officer is therefore denied."

It may have been a rather simplistic response to something so dark and secretive, but as a diplomat, she was aware that there was another level below Starfleet Intelligence. That was as much as she knew, though, having taken care not to learn anything more. If T'Koris was involved with that deeper level, it was well hidden beneath her accepted and acknowledged association with Starfleet Intelligence.

Things that no Captain had the right to do, in her mind anyway.

Starfleet Intelligence. Stark had to stop himself from sighing and putting his face in his palm. Of course, he knew the value of espionage. Every galactic power had their branch of intel. Still...it annoyed the living hell out of him. He'd never been one to be interested in the skunkworks branches of Starfleet, even though he'd done some things here and there over the years for SFI.

There had also been the two plain-clothes men that had approached him, maybe five or six years ago. They tried to be casual, but they couldn't have been anything other than intelligence agents. Those two had beaten around the bush, inferring much but coming out and saying little. Ultimately, he'd told them what to do with themselves.

"No objection to the named witnesses," Stark said, shrugging. He knew it'd probably drag this out, but...they did have a duty to see it done properly. "If there are no further protests, this Chair moves that the court proceed to the Defendant pleading to the individual charges, and then to examination and deposition."

Deacon had raised a slight eyebrow at Jiseth as she asked for further witnesses. She was certainly drawing up quite the list to call. One name caught her attention though, and she leaned in close to Admiral Stark. She wasn't sure how much Jiseth knew, but she didn't really want to give the Romulan any more information than necessary.

"Corman, the latest report from sickbay states that although Alpha's stable, she's not in any state to be moved. If Jiseth really wants her statement, then it may have to be done through video feed," she said softly.

Nodding, Stark gave a slight shrug. The amount of witnesses Jiseth wanted to call didn't really bother him. He was about to argue for the harshest possible punishment for her transgressions. She at least deserved to have the full story told. Full story, he thought, sighing inwardly. There seemed to be a hell of a lot boiling under the surface, and he was getting a little tired of feeling like he only knew part of a story. Stark was in the kind of mood to shake some branches and see what the hell fell out.

"It'd be up to Dr. Abols' discretion."

There was a moment before she realized her attention had shifted. Her head turned so swiftly that her hair fanned out from the centripetal force, gently coming back down to hang just below her chin on each side. Henriks was a name not heard in what seemed like a lifetime and a face not seen in just as long. She stood in silence however, as her gaze meandered back to Deacon. In her confinement she had been deprived of most outside contact. At times maddening.

Not in any state to be moved... What did you do to her?

Rachel nodded once to Stark to indicate her agreement. Henriks Abols, the chief of medicine aboard the station, would know far better whether or not Alpha was able to attend the court martial to give a statement. Turning her attention back to the lieutenant sitting in the middle of the floor, she brought her focus back to the matter at hand.

"Lieutenant Jiseth, in your position as Chief of Flight Operations aboard the Federation vessel USS Phoenix, registration NCC - 65025, you have been accused of the following: On Stardate 55536.8, you displayed rank insubordination against your captain; attempted sabotage of a vessel loaned to your crew by the Romulan Star Empire for the purposes of conducting a series of war games in the interest of furthering diplomatic relations, kidnapping a fellow Federation officer, Lieutenant Junior Grade Zero Alpha, with a view to turning her over to the Romulan Intelligence services and finally, espionage against the Federation and Starfleet on behalf of the Romulan Star Empire.
